When you want to apply for an employer sponsored subclass 482 Temporary Skill Shortage (TSS) visa, choose a job listed on the TSS Temporary Skills Shortage list. This visa is also called the 482 TSS visa and is an employer sponsored visa. It allows applicants to fill Australian work positions that are eligible skilled occupations on either for the short or long term.

Once you determine your job is on one of the skilled occupation lists and nominate it, you may need to apply for a skills assessment if your passport and the job requires a mandatory skills assessment.

When you need a Mandatory Skill Assessment

Mandatory skills assessments are only required if your occupation is listed in the following table and you hold a passport from one of the corresponding countries unless you have an exemption.

Key Requirements for Australian Employers

According to the Department of Home Affairs, there are key requirements that employers must meet when hiring qualified people from overseas including:

  • Offering a salary at the market rate.
  • Complying with international trade obligations where applicable.
  • The job must be a genuine position.
  • Meeting the requirements for testing the labour market.
  • Meeting the caveats if they apply to the job.
  • Complying with intra company transfers where the applicant is working outside of Australia for the company.
  • Make a 482 TSS visa nomination to position the transfer where applicable.

Temporary Skill Shortage Skilled Occupation List

The TSS Skilled Occupation List has following three areas from which you can choose your occupation from:

  1. Short Term Skilled Occupation List
  2. Medium and Long Term Strategic Skilled List
  3. Regional Occupation List.

Each occupation list has four columns:

  1. The first column is the item number.
  2. The second column gives the name of the occupation.
  3. The third column contains the ANZSCO code for the occupation and you need it for your 482 visa application.
  4. Column four has the number that corresponds with a caveats in the list of caveats, if any apply.

List of Caveats

The list of caveats in the following table correspond with occupations in column 2 of the previous tables where there is a caveat in column 3. These must be met as well as the normal requirements when nominating for an employer sponsored subclass 482 visa.

5 1.       the position has nominated annual earnings of less than AUD180,001; and

2.       if the nominee is to be transferred to fill the position—the transfer is not an intra corporate transfer to which an international trade obligation applies.

6 The position is a clerical, bookkeeper or accounting clerk position.
7 The position is involved in mass production in a factory setting.
8 The position is in a limited service restaurant.
9 The position predominantly involves responsibility for low‑skilled tasks.

Example 1: Rostering, maintaining records, reception duties and allocating duties to housekeepers, porters or doorpersons.

Example 2: Fruit picking or packing or feeding of livestock or animals.

Example 3: Truck driving.

10 The position is not located in regional Australia (within the meaning of sub regulation 5.19(16) of the Regulations).
11 The position:

1.       is based in a front‑line retail setting; or

2.       predominantly involves direct client transactional interaction on a regular basis.

12 The position:

1.       is not a full‑time position; or

2.       is not based in a therapeutic setting; or

3.       involves the provision of non‑medical relaxation massage; or

4.       is in a retail setting.

13 The position predominantly involves hairdressing or beauty therapy related non‑managerial tasks.
14 The position:

1.       is not located in a commercial building or shopping centre environment; or

2.       predominantly involves managing the provision of only one particular service to a facility or managing one particular relationship.

Example: Managing the cleaning contract for a facility but not for other contracts relevant to the facility.

15 The position:

1.       is based in a front‑line retail setting; or

2.       is based in a call centre and does not require a significant technical knowledge of products; or

3.       predominantly involves selling educational courses to individual students.

16 The position relates to mobile phone repairs.
17 The position relates to mass or standardised production (as opposed to specialist production), including the following:

1.       a position based in a franchise or factory;

2.       a position that:

a.       involves full or partial production of food product for distribution to another location; or

b.       predominantly involves the use of pre‑prepared food product from another location.

18 The position relates to animal husbandry, including caring for livestock on a farm.
19* The position is in a business that has an annual turnover of less than AUD1,000,000.
20 1.       the position is in a business that has an annual turnover of less than AUD1,000,000; and

2.       if the nominee is to be transferred to fill the position—the transfer is not an intra corporate transfer to which an international trade obligation applies.

21* The position is in a business that has fewer than 5 employees.
22 1.       the position is in a business that has fewer than 5 employees; and

2.       if the nominee is to be transferred to fill the position—the transfer is not an intra corporate transfer to which an international trade obligation applies.

23 The position has nominated annual earnings of less than AUD90,000.
24 Either:

1.       if the position is in a hospital—a health workforce exemption certificate that meets the requirements of subsection (2) has not been issued for the position; or

2.       if the position is not in a hospital—a health workforce certificate that meets the requirements of subsection (3) has not been issued for the position

25 The position has nominated annual earnings of less than AUD120,000.
26* The position has nominated annual earnings of less than AUD80,000.
Notes*:

2)       For the purposes of paragraph (a) of item 24 of the table in subsection (1), a health workforce exemption certificate must:

a.       specify:

i.                        the occupation; and

ii.                        the name of the person who nominates the occupation in relation to the nominee; and

iii.                        the name and location of the hospital; and

b.       have been issued during the 12 months ending when the nomination is made.

3)       For the purposes of paragraph (b) of item 24 of the table in subsection (1), a health workforce certificate must specify:

a.       the name and date of birth of the nominee; and

b.       the position in which the nominee is to work; and

c.        the location of the position; and

d.       the occupation.
