The Temporary Skills Shortage Visa (TSS Visa) – Subclass 482 allows employers to sponsor professionals from across the world to come to Australia to fill approved nominated occupations they cannot fill with a qualified Australian worker.

The visa subclass 482 has three streams—short term stream, medium term stream and labour agreement stream for an approved sponsor.

Eligibility Requirements for all Streams

The following eligibility applies to all subclass 482 visa streams:

Short Term stream

The short-term 482 visa stream allows you to stay in Australia for up to two years or up to four years where there is an International Trade Obligation. If you have a Hong Kong passport you may be able to stay for up to five years.

To be eligible for the temporary skill shortage visa short term stream, your occupation must be on the list of eligible short-term skilled occupations

You will need to meet the minimum standards of the English language to work in your occupation. It is essential to achieve at least an overall score of 5 on the IELTS test with a minimum score of 5 for each component on the test. There are alternative tests such as the TOEFL, CAE, OET and PTE Academic. There are exemptions to this requirement such as the type of passport you hold.

There are no age limits for this visa stream and you must genuinely only want to stay in Australia on a temporary basis.

The short-term stream costs from $1,290.

Medium Term Stream

The skill shortage visa medium term stream is for employers who have a position they need to fill with a foreign employee and the occupation is on the list of eligible medium and long-term skilled occupations.

You can work in Australia for up to four years but if you have a Hong Kong passport you can work in Australia for up to five years.

If your visa application is successful, you can only work in the nominated occupation unless you get an exemption from the Minister.

While in Australia you can study, but you will not get assistance from the government. It is a pathway to permanent residency if you are eligible.

Your nominated occupation must be on the medium and long term list of skilled occupations. If your visa application is successful, you can only work in the nominated occupation unless you get an exemption from the Minister.

There are no age limits for this visa stream. The cost of the labour agreement stream is from $2,690.

Priority Migration Skilled Occupation List

Currently the government is prioritising applications for visas and employer sponsored nominations for occupations on the Priority Migration Skilled Occupation List (PMSOL). This list currently has 44 occupations that are critical to Australia’s economic recovery after the pandemic.

Paying the Costs

The employer pays all the costs associated with the business nomination and sponsorship. This includes the costs for migration agent fees. It is against the law in Australia for an employer to pass these costs on to the worker.

Either you or the employer will pay the costs of the visa application. It is up to you and your employer to come to an agreement about these costs.

Your Obligations as a Temporary Skills Shortage 482 Visa Holder

Your obligations under the TSS visa includes meeting the health requirements and maintaining the appropriate level of health insurance in Australia.
